4.1 Where a pupil of compulsory school age fails to attend regularly at the school at which they are registered, and the absence is not authorised by the school, the local authority may issue a penalty notice to each parent in respect of each child.
4.2 For the purposes of this policy, «regular attendance» is assessed by reference to the national threshold: a penalty notice will be considered where a pupil has accrued ten or more sessions of unauthorised absence within a rolling period of ten school weeks. A «session» denotes a half day; a full day of absence therefore comprises two sessions.
4.3 Absence for the purpose of a holiday during term time will not be authorised save in exceptional circumstances determined by the headteacher, and any such absence will count towards the threshold in 4.2.
4.4 The penalty is £80 per parent per child if paid within 21 days of the notice, rising to £160 if paid between 22 and 28 days. Non-payment within 28 days may result in prosecution under section 444 of the Education Act 1996.
4.5 A second penalty notice issued in respect of the same child within a three-year period will be charged at £160 with no reduction for early payment. No further penalty notices will be issued within that period; a third instance of the conduct described in 4.1 will be referred directly for prosecution.
4.6 Absence authorised by the school on medical or other grounds, and absence arising from the school's own closure, do not count towards the threshold. Parents in receipt of certain benefits may apply for the notice to be withdrawn on hardship grounds; such applications must be made within 14 days of issue.

Attendance fines: what the new rule means for you
The bottom line: if your child misses five or more days without the school's permission in any ten-week stretch, you can be fined — and «you» means each parent, for each child.
Here is how it works, in plain English. The council counts absence in «sessions». A session is half a day, so a full day off is two sessions. The threshold is ten sessions — that is, five full days — of unauthorised absence within a rolling ten weeks. «Rolling» means the ten weeks can start on any day, not just at the beginning of a term. Put simply: the council looks back over the last ten weeks whenever a child is absent.
What counts and what doesn't. Absence the school has authorised — illness with a note, a hospital appointment — does not count. Nor do days the school itself is closed. A term-time holiday, however, does count unless the headteacher agrees it is exceptional, and in practice that is rare.
A worked example: a week's holiday in October (ten sessions) puts you on the threshold immediately; two days' unauthorised absence in November (four sessions) plus a week in January (ten) would not, because they are more than ten weeks apart.
The fine is £80 per parent per child if you pay within 21 days; it doubles to £160 if you pay between day 22 and day 28. The catch is the calendar: after 28 days the council can take you to court. A second fine within three years is £160 with no discount; a third time goes straight to court.
The one thing to remember: if you get a notice and receive certain benefits, you can ask for it to be withdrawn — but only within 14 days.
